These Terms of Use govern your access to and use of the HOME Initiative website, ballot, and related services. By accessing the website or submitting a ballot, you agree to these Terms of Use and the Privacy Policy.

1. About the HOME Initiative

The HOME Initiative, or Hongkongers' (Overseas) Movie Election, is co-organized by Canadian Hongkonger Incorporated for Motion-picture and Entertainment (CHIME), SHOWALKER STUDIO (UK) LIMITED, and Spiderweb Ponder Entertainment, an Australian business name operated by PONDER ENTERTAINMENT PTY LTD & SPIDERWEB ENTERTAINMENT PTY LTD.

In these Terms of Use, “HOME,” “we,” “us,” and “our” refer collectively to these co-organizers.

2. Eligibility and Age Restriction

You must be at least 18 years old to access, use, or submit a ballot through this website. By using the website or submitting a ballot, you represent and warrant that you are at least 18 years old and legally capable of accepting these Terms of Use.

3. Acceptance of These Terms

By accessing the website, viewing content, using the ballot, or clicking Submit, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, you must not use this website or submit a ballot.

4. Purpose of the Website

The website is provided for informational, participatory, promotional, and administrative purposes in connection with the HOME Initiative. We may revise, suspend, or discontinue any part of the website, its categories, timetable, eligibility rules, features, or content at any time.

5. Voting Rules

The HOME Initiative is intended to be a casual public voting activity for the current year. Each person may submit only one ballot per permitted voting period.

• Duplicate voting is prohibited.

• We may use email address verification, duplicate checks, CAPTCHA, analytics, and manual review to help protect the integrity of the voting process.

• We may invalidate, remove, or disregard a ballot if we reasonably believe that the same person has submitted more than one ballot, including where the email address and name are duplicated or substantially duplicated.

• Submission of a ballot does not guarantee that the ballot will be counted.

6. User Information and Accuracy

You agree to provide accurate, current, and complete information when using the website or submitting a ballot, including a valid email address. You must not impersonate another person, provide false identifying information, or use another person's contact details without authority.

7. Prohibited Conduct

You agree not to:

• submit more than one ballot per person;

• use bots, scripts, macros, automation, or other improper means to access or use the website;

• attempt to manipulate voting outcomes or interfere with the website's normal operation;

• bypass or interfere with CAPTCHA, security, or anti-abuse systems;

• upload or transmit malicious code, harmful material, or unlawful content;

• copy, scrape, harvest, or extract data from the website without authorization;

• use the website in any way that is unlawful, deceptive, abusive, or infringes the rights of others.

8. Intellectual Property and Film Rights

All website content, design, ballot structure, text, graphics, branding, logos, and original materials used by the HOME Initiative are owned by us, licensed to us, or otherwise used with permission, and are protected by applicable intellectual property laws.

All rights in and to films, film titles, posters, stills, clips, trademarks, publicity materials, and related content remain with their respective copyright owners, producers, distributors, licensors, rights holders, or other authorized parties. Nothing on this website transfers any ownership or license to you except the limited right to use the website for its intended lawful purpose.

9. Withdrawal Request by Rights Holder

If the international rights owner, authorized licensor, producer, distributor, or other authorized rights representative of a nominated film wishes to request withdrawal of that film from the voting or from related website presentation, they must contact us directly at contact@hkmovie.ca. We may request reasonable evidence of authority before acting on the request.

10. Third-Party Links and Databases

The website may contain links to third-party websites or databases, including film information platforms. These links are provided for convenience only. We do not control and are not responsible for the content, availability, or privacy practices of third-party services. Your use of third-party links is at your own risk.

11. Privacy, Communications, and Marketing

Your use of the website is also governed by our Privacy Policy. By submitting information through the website, you acknowledge that your information may be collected and used for ballot administration, communications, fraud prevention, analytics, and related project purposes.

Where disclosed on the website, clicking Submit may also mean that you agree to receive communications, including marketing or promotional emails, from the organizations listed in the website footer. You may unsubscribe from marketing emails after receiving the first email.

12. Disclaimer and Availability

The website and all related content are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted access, error-free operation, or that all information on the website will be complete, current, or accurate at all times.

13. Limitation of Liability

To the fullest extent permitted by applicable law, we and our co-organizers will not be liable for any indirect, incidental, special, consequential, or economic loss arising from or related to your use of, or inability to use, the website or your participation in the voting process. This includes, without limitation, loss of data, invalidated ballots, service interruptions, and unauthorized access to systems or information.

14. Indemnity

You agree to indemnify and hold harmless the HOME Initiative and its co-organizers from and against claims, liabilities, damages, costs, and expenses arising out of your breach of these Terms of Use, misuse of the website, unlawful conduct, or infringement of the rights of any person or entity.

15. Changes, Suspension, and Termination

We may update these Terms of Use, suspend access to the website, restrict features, invalidate ballots, or terminate access at any time where we consider it reasonably necessary to protect the operation, integrity, or lawful use of the website.

16. Governing Law

These Terms of Use and any dispute arising from or related to the website or the HOME Initiative shall be governed by the laws of Ontario, Canada, and the applicable federal laws of Canada, without regard to conflict of law principles.
